Terms of Service
These Terms set out the rules for using CookBooks. Please read them carefully - by using the Service, you agree to be bound by them.
CookBooks is an AI-powered recipe app. You can use it for free or subscribe to a paid plan. You must be at least 13 to use CookBooks, and at least 18 to pay for a subscription (or have a parent or guardian subscribe on your behalf). Recipes are generated by AI and may contain mistakes - always check them before you cook. We can suspend accounts that abuse the Service. If you disagree with these Terms, please stop using the Service. This summary is informational only; the numbered sections below are the binding agreement.
Contents
1. Acceptance of These Terms
These Terms of Service ("Terms") form a binding agreement between you and the operator of CookBooks ("CookBooks", "we", "us", or "our") regarding your access to and use of the cookbooks.ink website, related domains, and any associated applications or services (together, the "Service").
By creating an account, signing in, or otherwise using the Service, you confirm that you have read, understood, and agreed to these Terms and to our Privacy Policy, which is incorporated by reference. If you do not agree, you must not use the Service.
2. The Service
CookBooks is an AI-powered recipe generation and management platform. Its features include, among others, a smart recipe generator, an inspiration mode for creative suggestions, a recipe transformer, a saved-recipe collection, and personalised recommendations.
We are continually improving the Service. We may add, change, or remove features at any time. Where a change materially reduces the functionality available to paying subscribers, we will give reasonable notice in advance.
3. Eligibility and Age Requirements
To use the Service you must:
- be at least 13 years old;
- have the legal capacity to enter into a binding contract in your jurisdiction, or - if you are a minor - have a parent or legal guardian review these Terms with you and accept them on your behalf;
- not be barred from receiving the Service under the laws of your country of residence or any other applicable jurisdiction;
- use the Service in compliance with these Terms and all applicable laws.
To purchase a paid subscription you must be at least 18 years old (or the age of majority in your jurisdiction). If you are under that age, a parent or legal guardian aged 18 or older must complete the purchase on your behalf and will be the contracting party responsible for payment.
4. Accounts and Security
You can create an account using an email address and password or by signing in with a supported identity provider such as Google. You are responsible for:
- providing accurate and up-to-date registration information;
- maintaining the confidentiality of your account credentials;
- all activity that takes place under your account, whether or not authorised by you;
- notifying us promptly at legal@mail.cookbooks.ink if you believe your account has been compromised.
You may not share your account, sell it, or let another person use it. One individual, one account.
5. Subscriptions, Billing, and Refunds
a. Paid plans
CookBooks offers paid subscription tiers (for example, "Pro" and "Family"). The features, limits, and prices of each tier are described on our pricing page. Prices are quoted in the currency shown at checkout and may exclude applicable taxes, which will be added where required.
b. Billing cycle and auto-renewal
Paid subscriptions are billed in advance on a recurring basis (monthly or annually, as selected at checkout) and will automatically renew for successive periods of the same length until cancelled. By subscribing, you authorise us and our payment processor, Stripe, to charge your selected payment method at the start of each billing period.
c. Payment processor
Payments are processed by Stripe, Inc. Your card details are provided directly to Stripe and are handled in accordance with the Stripe Services Agreement and its privacy policy. We do not store your full payment-card number.
d. Cancellation
You can cancel your subscription at any time from your account settings. Cancellation stops future billing. You will continue to have access to your paid features until the end of the current billing period, after which your account will revert to the free tier.
e. Refunds
Except where required by applicable law (including, for consumers resident in the European Union, the United Kingdom, or similar jurisdictions that grant statutory withdrawal rights), payments for subscriptions are non-refundable, and we do not provide refunds or credits for partial subscription periods, unused features, or changes to pricing that take effect at your next renewal.
If you are a consumer in the EU or UK, you may have the right to withdraw from a new subscription within 14 days of signing up. By starting to use the paid features before that period ends, you expressly request immediate performance of the Service and acknowledge that you may lose the right of withdrawal once the Service has been fully provided. Where we are legally required to refund, we will issue any refund due using the original payment method.
f. Price changes
We may change subscription prices from time to time. We will give you at least 30 days' notice before a price change takes effect. If you do not accept the new price, you can cancel your subscription before the next renewal date.
g. Failed payments
If a payment fails, we may retry the charge, downgrade your account to the free tier, or suspend paid features until payment is received. You are responsible for any fees your bank or card issuer imposes.
h. Fair use
CookBooks Pro includes unlimited recipe generation for personal use. We apply fair use limits to prevent automated abuse and ensure service quality for all users. Accounts generating recipes at a volume inconsistent with personal use may be subject to rate limiting or review.
6. AI-Generated Content and Food Safety
Recipes and suggestions generated by CookBooks are produced by a large language model. They may contain inaccuracies, unsafe substitutions, missing or incorrect allergen information, unusual ingredient combinations, or incorrect cooking times and temperatures. You must use your own judgement before preparing or consuming any recipe.
By using the Service, you acknowledge and agree that:
- The Service is an aid for meal inspiration and recipe ideas. It is not a substitute for professional culinary, nutritional, medical, or dietary advice.
- You are solely responsible for verifying that every ingredient and preparation step is safe, appropriate for your skill level, and suitable for the people you are cooking for - including any allergies, dietary restrictions, religious requirements, or medical conditions.
- You must handle and cook food in accordance with basic food-safety principles, including proper temperatures for meat, poultry, seafood, eggs, and similar ingredients, and safe handling of raw foods.
- If a recipe suggests an ingredient or preparation that conflicts with any known allergy, intolerance, or medical advice, do not rely on the recipe and consult a qualified professional.
- We cannot guarantee the availability, freshness, quality, or suitability of any ingredient, and we do not endorse any particular brand or supplier.
To the maximum extent permitted by law, CookBooks disclaims all liability for any injury, illness, allergic reaction, loss, or damage arising from your reliance on AI-generated recipes or other output of the Service. Use the Service at your own risk and always exercise good judgement.
7. Your Content
"Your Content" means the recipes, notes, preferences, tags, images, and other material you upload, create, or save through the Service.
You keep ownership of Your Content. You grant CookBooks a worldwide, non-exclusive, royalty-free licence to host, store, reproduce, and display Your Content solely for the purpose of operating, providing, and improving the Service for you. This licence ends when you delete Your Content or your account, except for reasonable technical backups and to the extent retained as part of aggregated or de-identified data that can no longer identify you.
You are responsible for Your Content. You represent that you have all rights necessary to submit it, and that it does not violate any law or third-party right. We may remove Your Content if we reasonably believe it violates these Terms or applicable law.
8. Acceptable Use
You agree not to, and not to permit anyone else to:
- use the Service in violation of any law or regulation, or for any fraudulent or harmful purpose;
- attempt to reverse-engineer, decompile, or otherwise derive the source code of the Service;
- interfere with, disrupt, or circumvent the security, integrity, or performance of the Service;
- scrape, crawl, or harvest data from the Service without our prior written consent, or use automated means to create accounts or submit prompts;
- use the Service to generate content that is hateful, harassing, defamatory, sexually explicit involving minors, or otherwise unlawful;
- use the Service to build or train a competing product, machine-learning model, or large language model;
- impersonate any person or misrepresent your affiliation with any person or entity;
- resell, sublicense, or commercially exploit the Service other than through a plan that expressly permits such use.
9. Intellectual Property
The Service, including the CookBooks name, logo, interface, underlying software, text, graphics, and other content we provide (excluding Your Content), is owned by CookBooks or its licensors and is protected by intellectual-property laws. We grant you a limited, personal, non-transferable, non-exclusive, revocable licence to access and use the Service in accordance with these Terms. All rights not expressly granted are reserved.
Feedback you send us is not confidential. By sending feedback, you grant us a perpetual, royalty-free licence to use it to improve the Service.
10. Third-Party Services
The Service relies on third-party providers, including Supabase (authentication and database), OpenAI (recipe generation), Google (sign-in with Google), and Stripe (payments). Your use of those providers' services is subject to their own terms and privacy policies. We are not responsible for third-party services or for any content, information, or functionality they provide.
11. Disclaimers
The Service is provided "as is" and "as available". To the maximum extent permitted by law, CookBooks disclaims all warranties, whether express, implied, or statutory, including implied warranties of merchantability, fitness for a particular purpose, non-infringement, and any warranty arising from course of dealing, course of performance, or usage of trade.
We do not warrant that the Service will be uninterrupted, error-free, or free of harmful components, or that any recipe, suggestion, or output produced by the Service will be accurate, complete, reliable, current, or safe. Nothing in these Terms limits any warranty or right that cannot be excluded or limited under applicable consumer-protection law.
12. Limitation of Liability
To the maximum extent permitted by law, CookBooks, its operators, contractors, and service providers will not be liable for:
- indirect, incidental, special, consequential, exemplary, or punitive damages;
- loss of profits, revenue, data, goodwill, or business opportunities;
- any illness, injury, allergic reaction, or other harm arising from your reliance on AI-generated recipes or other output of the Service;
- damages arising from unauthorised access to your account caused by your failure to safeguard your credentials.
Our total aggregate liability to you for all claims arising out of or relating to the Service in any twelve-month period is limited to the greater of (a) the amount you paid us for the Service in that period, or (b) fifty US dollars (USD 50). Some jurisdictions do not allow the exclusion or limitation of certain damages; in those jurisdictions our liability is limited to the smallest extent permitted by law.
13. Indemnification
You agree to defend, indemnify, and hold harmless CookBooks and its operators, contractors, and service providers from and against any claims, damages, liabilities, costs, and expenses (including reasonable legal fees) arising out of or relating to: (a) your use of the Service; (b) Your Content; (c) your breach of these Terms; or (d) your violation of any law or third-party right.
14. Suspension and Termination
You can stop using the Service and delete your account at any time from your account settings.
We may suspend or terminate your access to all or part of the Service, with or without notice, if:
- you breach these Terms or our Privacy Policy;
- your account is inactive for an extended period;
- we reasonably believe that continued use would expose CookBooks, another user, or a third party to legal liability or security risk;
- we are required to do so by law or by a valid order of a court or regulator;
- we decide to discontinue the Service or a material feature.
Sections that by their nature should survive termination - including intellectual-property, disclaimers, limitation of liability, indemnification, and dispute-resolution provisions - will survive.
15. Governing Law and Disputes
These Terms are governed by the laws of the jurisdiction in which the operator of CookBooks is ordinarily resident, without regard to its conflict-of-law principles. Mandatory consumer-protection laws of your country of residence continue to apply where they give you stronger protection.
Before filing a claim, you agree to contact us at legal@mail.cookbooks.ink and attempt in good faith to resolve the dispute informally for at least 60 days. If we cannot resolve the dispute informally, you and we agree that any claim will be brought exclusively in the competent courts of that jurisdiction, unless applicable law requires you to be able to bring the claim in your place of residence.
You and CookBooks agree that each may bring claims only on an individual basis, and not as a plaintiff or class member in any purported class, consolidated, or representative action, to the extent permitted by law.
16. Changes to These Terms
We may update these Terms from time to time. When we make a material change, we will update the "Last updated" date at the top of this page and, where appropriate, notify you by email or through an in-product notice. Changes take effect on the date they are posted, or on such later date as we specify. Your continued use of the Service after changes take effect means you accept the revised Terms. If you do not agree with the changes, you must stop using the Service and may cancel your subscription.
17. Miscellaneous
- Entire agreement. These Terms, together with the Privacy Policy and any additional terms you agree to for specific features, are the entire agreement between you and CookBooks regarding the Service.
- Severability. If any provision is held to be unenforceable, that provision will be modified to the minimum extent necessary to make it enforceable, and the remaining provisions will remain in full force and effect.
- No waiver. Our failure to enforce a provision is not a waiver of our right to do so later.
- Assignment. You may not assign these Terms without our prior written consent. We may assign these Terms in connection with a merger, acquisition, or sale of assets.
- Force majeure. We are not liable for delays or failures caused by events beyond our reasonable control.
- Notices. We may give notices by email, through the Service, or by posting them on this website. Notices to us should be sent to the legal email below.
